Terms & conditions

Last updated: 25 October 2026

These Terms & Conditions (“Terms”) are an agreement between you and Here Goes Kenya (“we”, “us”, “our”), based in Kenya, and govern your use of heregoeskenya.com (the “Site”), including browsing, creating an account, listing a place, writing reviews or posts, and messaging other users. By using the Site or creating an account, you agree to these Terms and to our Privacy Policy, Cookie Policy and Disclaimer. If you do not agree, please do not use the Site.

1. What Here Goes Kenya is

Here Goes Kenya is an online travel directory and community for discovering places, tours, activities and experiences in Kenya. The Site lets users:

  • search and browse listings of places and regions, with maps and photos;
  • create a profile, follow other users, and save listings to collections;
  • write reviews and ratings, post to timelines and a newsfeed, reply to posts, and submit blog posts or articles;
  • send direct messages to other users and listing owners;
  • add listings for a place or tour, or claim an existing listing; and
  • view third-party content such as Google ratings and reviews, and Viator tours.

2. Our role

We are not a travel agent, tour operator, accommodation provider or ticket seller. We do not organise, operate, sell, vouch for or guarantee any tour, stay, activity or service shown on the Site.

  • Any enquiry, booking or purchase you make is a contract between you and the business, host or partner, on their terms. We are not a party to it and do not handle bookings or payments between users and businesses. “Book Now” links take you to the business’s or partner’s own website or booking system.
  • Listings are provided by their owners and other users. A listing on the Site, or a rating, badge or ranking, is not an endorsement, recommendation, licence check or safety certification by us.
  • Users who list places (“Partners” or “Local Experts”) are independent from us. They are not our employees, agents, partners in a legal sense or representatives, and cannot speak or contract for us.
  • No earnings promise. We do not promise any number of visitors, enquiries, bookings, sales, earnings or search rankings. Listing on the Site may lead to business or income, or it may not, and results differ from one listing to another. Statements on the Site about audience size, reach or earning potential describe what is possible, not what you will get. You list at your own risk and cost, and we are not liable if you earn less than you expected or nothing at all.

3. Eligibility and accounts

  • You must be at least 18 years old to create an account, list a business, or post content. If you are younger, you may browse the Site with a parent or guardian.
  • You can register with an email address and password, or with your Google account. We verify email addresses before an account becomes active.
  • Give accurate information and keep it up to date. Use your real identity or the real name of the business you represent. Do not impersonate any person or organisation.
  • You are responsible for your password, for everything done through your account, and for keeping your account secure. Tell us immediately at hello@heregoeskenya.com if you suspect unauthorised use.
  • One person, one account. Do not create accounts to avoid a suspension or ban, or to manipulate ratings or visibility.
  • If you act for a business, you confirm that you are authorised to bind it to these Terms.

4. Listings: places and tours

4.1 Who can list

You may add or claim a listing only if you own the business, or you are authorised by the owner. Do not list a place you do not run unless you are submitting it as a user-contributed listing in good faith and are not representing yourself as the owner.

4.2 Review and publishing

New places are reviewed by us before they are published, and we may approve, edit, ask for changes, or reject them. After a listing is live, edits you make normally go live straight away without a new review, so you stay responsible for keeping the listing accurate and compliant. We may review, change or unpublish any listing at any time.

4.3 What a listing must contain

  • Information (description, tours and activities, prices, opening hours, FAQs, contact details, website, social links, photos, videos, location and map pin) must be accurate, current, lawful, not misleading, and not copied from someone else’s site without permission.
  • The contact and “Book Now” details must lead to the genuine business or booking page.
  • You must hold and keep valid every licence, permit and insurance your business needs to operate and advertise lawfully in Kenya, for example business, county, tourism, park or conservancy, vehicle and guide permits where they apply. We may ask to see them.
  • You must tell us promptly if a listing becomes inaccurate, or the business closes or changes.
  • You must not use keywords, categories, names or images misleadingly, or try to trade on another business’s name or reputation.

4.4 Tours, activities and wildlife

If you list tours, safaris, hikes, water activities, or wildlife experiences, you confirm that they operate lawfully and safely, that guides and vehicles are properly licensed and insured, and that you follow park, conservancy and conservation rules. Listings must not offer or promote hunting or poaching, trade in protected wildlife or wildlife products, close contact with wild animals that harms them, or any activity that breaks the Wildlife Conservation and Management Act, 2013 or other applicable law.

4.5 Claiming a listing

If a listing about your business already exists, you can ask to claim it. We may require proof of ownership or authority, such as registration documents or an authorisation letter. We approve claims manually and may refuse, delay or reverse a claim if the proof is insufficient, false or disputed. Providing false proof may lead to account termination and, where appropriate, reporting to the authorities. If two parties claim the same listing, we may decide who may manage it, and our decision is final as far as the Site is concerned.

4.6 Our rights over listings

We may edit, merge, reclassify, hide, unpublish or remove any listing that breaks these Terms, is inaccurate, a duplicate, outdated, unsafe or unlawful, or that we reasonably consider harmful to users or to the Site.

5. Your content

“Your content” means everything you submit to or create on the Site, including listings, descriptions, photos, videos, logos, profile information, reviews, ratings, timeline posts and replies, newsfeed posts, collections, blog posts or articles, and messages. You keep ownership of your content. You are responsible for it and for any harm or loss it causes.

5.1 Licence you give us

By submitting content, you give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, crop, adapt, translate, display, distribute and promote your content on the Site, in our newsletters, and on our social media and marketing channels, in connection with operating and promoting the Site. We may sublicense this to our service providers (such as hosting and translation services) only to the extent needed to run the Site. You also allow other users to view and share content you make public, within the features of the Site. The licence lasts for as long as your content is on the Site. If you delete content, we will remove it from public view within a reasonable time, but copies may remain in backups, caches, search engines, or where others have shared or quoted it.

5.2 What you promise

You confirm that:

  • you own your content or have all permissions needed to post it and to give us the licence above;
  • it does not infringe anyone’s copyright, trademark, privacy, publicity or other rights;
  • it is truthful, not misleading, and not defamatory;
  • photos and videos showing identifiable people were taken with their consent, and for children, with a parent or guardian’s consent; and
  • it does not contain malware, spam, or content that breaks these Terms or the law.

Only upload photos you took or have permission to use. Photos can contain hidden location data (EXIF), so remove it if you do not want it published. Do not publish other people’s personal data, such as phone numbers, IDs, or private messages, without their consent.

5.3 Posts, newsfeed and collections

Timeline posts, replies and newsfeed items appear publicly unless you choose otherwise in the settings the Site offers. Public collections are visible to everyone. Private collections are visible only to you. Posts may be limited in length, number of images and frequency, and we may limit or remove content that is repetitive or spammy. Published content is not pre-approved, so what you post can appear immediately.

5.4 Blog posts and articles

If you submit an article or blog post, it must be original (or properly licensed), accurate, relevant to travel in Kenya, and free of undisclosed advertising. You must disclose any payment, free stay, commission or other benefit you received for it. We may edit, move, unpublish or remove articles, and we are not obliged to publish anything you submit.

5.5 Moderation

We do not review all content before it appears and are not responsible for content posted by users. We may remove or restrict any content, or limit visibility of it, if we reasonably think it breaks these Terms or the law, or is harmful, and we may do so without notice. Our moderation decisions are made at our discretion, and we are not required to host any content.

6. Reviews and ratings

  • Reviews must be honest and based on your own genuine experience of the place or tour.
  • You may not review your own business, a business you work for or are related to, or a competitor’s. You may not offer, request or accept payment, discounts or other rewards in exchange for a review, or post reviews to harass, defame or pressure a business.
  • Keep reviews factual. Do not include personal attacks, threats, private information or false accusations.
  • Businesses may not pressure, threaten or bribe reviewers, or delete or hide reviews they dislike by abusing the Site’s tools.
  • We may remove any review that breaks these Terms or our rules, including after a complaint from a business or user, but we are not obliged to remove a review just because a business disagrees with it. We do not guarantee that review scores reflect any business’s actual quality.
  • Ratings and reviews shown from Google are collected and moderated by Google, not by us.

7. Messages

You may send direct messages to other users and listing owners. Messages must be about genuine enquiries and community interaction. Do not send spam, unsolicited promotions, scams, phishing links, threats or harassment. Messages may include one image or video attachment. Only send files you have the right to share. We do not read messages routinely, but we may review messages that are reported, or when we suspect abuse, fraud or illegal activity, or when the law requires. Messages are deleted from the Site after a period explained in our Privacy Policy. Keep any messages you need for your own records. Be careful about paying anyone off the Site, and never send payment details to a stranger. We are not responsible for what happens in dealings that start on the Site.

8. Following, sharing and social features

You can follow users and share pages through buttons for platforms such as Facebook, X, LinkedIn, Reddit and WhatsApp. When you share to another platform, that platform’s terms and privacy policy apply, and we do not control what happens there. Do not use the Site’s social features to harass others, to manipulate engagement, or to promote spam.

9. Acceptable use

You must not:

  • post anything unlawful, defamatory, hateful, threatening, sexually explicit, discriminatory, or that encourages violence, exploitation, trafficking or illegal activity, including wildlife crime;
  • post spam, misleading, fake or machine-generated content, or links meant to boost the search ranking of other sites;
  • upload malware, or try to disrupt, probe, overload or gain unauthorised access to the Site, other accounts or our systems, in breach of the Computer Misuse and Cybercrimes Act, 2018 or other law;
  • scrape, copy, mirror or bulk-download the Site’s content, listings, reviews or database, or use bots or automated tools, without our written permission;
  • circumvent rate limits, moderation or security measures, or create fake accounts, fake likes, follows or reviews;
  • collect other users’ personal data, or use the Site or its messages to send unsolicited marketing;
  • misrepresent your identity, affiliation, qualifications or the nature of your business;
  • use the Site’s content or Google, Viator or other third-party data in a way that breaks their terms; or
  • use the Site in any way that breaks Kenyan law or the rights of others.

10. Free to use, and paid features in future

The Site, including creating an account, listing a place, and claiming a listing, is currently free. We may introduce paid features in future, such as subscription plans or promoted listings. If we do, we will show the price, billing period, renewal and cancellation terms before you pay, and you will only be charged if you agree. Unless the law gives you a right to a refund or remedy (including under the Consumer Protection Act, 2012), paid features will not be refundable once started, and they will not guarantee any number of views, bookings, sales or rankings. We will update these Terms before paid features go live.

11. Advertising, affiliate links and sponsored content

  • The Site shows advertising, including Google AdSense ads. Ads are provided by third parties. Their appearance is not an endorsement, and we are not responsible for advertisers’ products, claims or privacy practices.
  • Some links on the Site are affiliate links, including to Viator, Booking.com, GetYourGuide and other partners. We may earn a commission if you book or buy through them, at no extra cost to you. Affiliate relationships do not change the price you pay. See our Disclaimer.
  • We may label content as sponsored or partner content. Partner and affiliate content may be shown more prominently than other content.

12. Third-party content, services and links

  • The Site shows or uses content and services from third parties, including Google (Maps, Places, ratings and reviews, sign-in, Translate), Viator tours, YouTube videos, and links to other sites. This content belongs to those third parties and is governed by their own terms and policies. By using those features you also agree to those terms, such as the Google Maps Platform terms.
  • We do not control, check or guarantee third-party content or sites. It may be wrong, out of date, unavailable, or change without notice, and we are not responsible for it, for any loss you suffer from using it, or for the privacy practices of those third parties.
  • Prices, availability, itineraries and descriptions on partner sites are set by the partner. Confirm details with the provider before you pay.
  • Any disagreement with a business, tour operator, host or partner is between you and them. We are not a party and cannot resolve it, refund you, or compensate you.

13. Travel information, safety and maps

Travel in Kenya carries risks, including to health, safety, wildlife, road conditions, weather and security. Visa, entry, health, permit, park fee, currency and conservation rules change, and some places may be restricted. Information on the Site is general, may be out of date or incomplete, and is not professional travel, medical, legal or safety advice.

You are responsible for checking current information with the relevant provider or authority, for your own safety and that of the people in your care, for arranging suitable travel and health insurance, for vaccinations and medicines, and for following local laws, park and conservancy rules, and the instructions of rangers and guides. Maps, pins, distances and directions are approximate and may be wrong. Take care when using them, especially in remote areas or at night. See our Disclaimer for more.

14. Automatic translation

The Site offers machine translation through Google Translate. Translations may be inaccurate or incomplete and should not be relied on for anything important. The English version of the Site and of these Terms is the authoritative version.

15. Our intellectual property

The Site and everything on it, including its design, text, logos, graphics, software, structure and database, other than your content and third-party content, belongs to us or our licensors and is protected by law. “Here Goes Kenya” and our logo are our trademarks, and you may not use them without our written permission. You may view and share pages of the Site for personal, non-commercial use, but you may not copy, modify, republish, sell or commercially exploit our materials without our written permission. If you send us feedback or ideas, we may use them without obligation to you.

16. Copyright and takedown notices

We respect intellectual property rights and expect users to do the same. If you believe content on the Site infringes your copyright or another right, email hello@heregoeskenya.com with the subject “Takedown” and include:

  • your name and contact details;
  • a description of the work you say is infringed, and proof that you own it or act for the owner;
  • the exact URL of the content on the Site;
  • a statement that you have a good-faith belief the use is not authorised; and
  • a statement that the information in your notice is accurate.

We may remove or disable the content, notify the user who posted it, and share your notice with them. The user may respond by email, and we may restore content if the claim appears mistaken or is withdrawn. Repeat infringers will have their accounts terminated.

17. Reporting and enforcement

To report illegal, harmful, inaccurate or abusive content or behaviour, email hello@heregoeskenya.com with the subject “Report”, including the link to the content. We review reports in our discretion and may remove content, warn users, restrict features, suspend accounts or cooperate with the authorities. If we remove your content or restrict your account, you can reply to the email we send, or write to us, and ask us to reconsider, explaining why you think we were wrong. We may keep records of reports and enforcement actions.

18. Suspension and termination

You may stop using the Site and delete your account at any time from your dashboard or by emailing us. We may suspend or terminate your account, restrict features, or remove content, with or without notice, if you break these Terms, if we are required to by law, if your use creates risk or legal exposure for us or others, if your account is inactive for a long period, or, once paid features exist, if you do not pay for one. If we terminate your account without cause, we will refund any prepaid fees for the period after termination.

When an account is deleted, your profile and private information are removed as described in our Privacy Policy. Public content such as reviews may be deleted or anonymised at our discretion, and copies may persist as explained in section 5.1. Sections that by their nature should survive (including content licences for copies already made, intellectual property, disclaimers, liability, indemnity and governing law) will continue to apply.

19. Privacy, cookies and communications

How we handle personal data is explained in our Privacy Policy, and how we use cookies in our Cookie Policy. By registering, you agree that we may send you service messages by email and in the Site, such as verification, security alerts, notifications about your listings, reviews, messages and followers, and changes to these Terms. These are different from marketing newsletters, which we send only if you subscribe, and you can unsubscribe at any time.

20. Disclaimers

The Site is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including accuracy, fitness for a particular purpose, and non-infringement. We do not promise that the Site will be error-free, secure, or always available, or that listings, reviews, maps, translations or third-party content are accurate, complete or reliable. We are not responsible for the acts, omissions, quality, safety, legality or pricing of any business, host, guide, user, tour or partner you find through the Site.

21. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, goodwill or business opportunity, or for injury, loss, damage, delay, cancellation or inconvenience arising from travel, tours or services you find through the Site, from your dealings with other users, businesses or partners, or from content on the Site. Our total liability to you for any claim relating to the Site is limited to KES 1,000 or, if higher, the amount you paid us in the 12 months before the claim arose.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including for death or personal injury caused by negligence, for fraud, or any rights you have as a consumer under Kenyan law.

22. Indemnity

You agree to compensate us, and hold us harmless, for losses, claims and reasonable legal costs that arise from your content, your listing, the services you offer, your breach of these Terms, or your violation of law or of another person’s rights. If you list a business, this includes claims from customers, guests, attendees or authorities relating to that business.

23. Changes

We may change the Site, its features, and these Terms from time to time, for example when we add features, change how things work, or when the law changes. When we make material changes to these Terms, we will update the “Last updated” date and tell registered users by email or on the Site. If you continue to use the Site after a change takes effect, you accept the updated Terms. If you do not agree, stop using the Site and, if you wish, delete your account.

24. Governing law and disputes

These Terms are governed by the laws of Kenya. If a dispute arises, please contact us first at hello@heregoeskenya.com so we can try to resolve it in good faith. If we cannot resolve it within 30 days, either of us may bring the matter before the courts of Kenya, which have exclusive jurisdiction, except that nothing prevents us from seeking urgent relief to protect our rights. If you are a consumer, this does not remove any rights or remedies you have under Kenyan consumer protection law.

25. General

  • Entire agreement. These Terms, with the policies they refer to, are the whole agreement between you and us about the Site.
  • Severability. If a part of these Terms is found unenforceable, the rest remains in effect.
  • No waiver. If we do not enforce a right straight away, that does not mean we give it up.
  • Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours to a successor of our business.
  • No third-party rights. Only you and we can enforce these Terms, except that our service providers and licensors may rely on the protections in sections 20 to 22.
  • Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages, power or internet failures, or acts of government.
  • Notices. We may send notices to the email address on your account or post them on the Site. You can contact us at the address below.
